I. The host of the exhibition will strengthen the IPR protection and set up an IPR on-site Administration Office during the session of the exhibition.
II. All exhibitors should attend the exhibitions legally and not infringe others¡¯ IPR. While concerning any IPR infringements, the exhibitors should coordinate the investigation involved in IPR related issues.
III. Exhibitors with valid badge of this fair can lodge a Complaint to the Administration Office in case that any infringements have been detected in the exhibits, promotional materials in the booth or in any displaying parts of the booths.
IV. For the purpose of filing a complaint, right holders are required to provide the documents as follows:
(I) Legal and valid certificate of IPRs ownership. In case of patent rights, the Patent Certificate, the Patent Specification, the ID Certificate of patent owner and the Certificate on Legal Status of Patent Rights are required; in case of trademarks, the evidential document on trademark registration as signed by the complainer, as well as the ID certificate of the trademark owner are required; in case of copyrights, the certificate of copyright ownership as well as the ID certificate of the copyright holders are required.
(II) Basic information on the party that is suspected to have infringed upon the IPRs.
(III) Reasons and evidences for the suspicion of IRPs infringement.
(IV) In case of a complaint filed by an agent, the Letter of Authorization concerned shall be provided.
V. The exhibitors should abide by the regulations of the host and committee that:
(I) Guarantee all exhibits, catalogs, note manuals, software and hardware will not infringe upon the patent and copyright
(II) If required, exhibitors should agree to submit relevant documents and certificates of the exhibits, such as patent certificate, technology transfer certificate or professional skills, design certificates, copyright and trademarks to protect their rights
(III) If required, the exhibitors should submit a statement document to state that every exhibit is complied with the relevant Indian laws and regulations.
(IV) Agree to abide by the local rules of IPR protection and protect patent and copyright.
(V) Once agreed patent or copyright disputes of complaints, timely notification and Exhibition Management Office. If required, and agreed to a lawyer to provide legal advisers and support to resolve disputes
Agree that, once the patent or copyright disputes occurred, timely inform the Administration Office. If required, have recourse to the layers to settle the disputes.
(VI) The exhibiting enterprises should abide by the decisions made by the local judicial, intellectual property administration agencies or the exhibition organizers on the IPR disputes.
VI. This regulation applies to both the Chinese and foreign enterprises.
